Terms of Service

These Terms of Service ("Terms") govern your access to and use of onano.app, including our website, applications, AI-powered editing tools, and related services (the "Service"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use the Service.

2. Accounts

You are responsible for maintaining the confidentiality of your account and for all activity under it. You agree to provide accurate registration information and keep it updated.

3. Subscriptions and Payments

Certain parts of the Service may require a paid subscription.

Fees, billing periods, renewals, trials, refunds, and cancellation terms are described on our pricing page or order form. Unless otherwise stated, subscriptions renew automatically until cancelled.

Paid subscriptions renew automatically unless cancelled before the next billing date.

If offered, free trials convert automatically into a paid subscription unless cancelled before the trial ends.

For consumers in the EU/EEA, a 14-day statutory right of withdrawal may apply from the date of purchase. By starting to use the Service immediately, you expressly consent to immediate performance and acknowledge that your right of withdrawal may be reduced or lost once the Service has been used.

Except where required by law, subscription fees are non-refundable once a billing period has started.

4. Your Content

You retain full ownership of all videos, audio, images, text, brand assets, and other content you upload, import, create, or export through the Service ("User Content").

You represent that you own or have the necessary rights to use all User Content.

5. License to Operate the Service

To provide the Service, you grant us a limited, non-exclusive, worldwide license to host, process, analyze, transcribe, edit, transform, subtitle, resize, and generate derivative outputs from your User Content solely for the purpose of operating, improving, and delivering the Service.

This license ends when your content is deleted from the Service, except where retention is required for legal, backup, or security reasons.

6. AI Outputs

The Service may generate suggested clips, captions, titles, descriptions, reframing, or other AI-assisted outputs.

These outputs may contain errors, omissions, inaccurate captions, poor edits, or unsuitable recommendations. You are responsible for reviewing all outputs before publishing, sharing, or commercial use.

We do not guarantee performance, engagement, reach, monetization, or virality.

7. Third-Party Integrations

If you connect third-party platforms such as Google / YouTube, Meta / Instagram, TikTok, storage, or publishing services, you authorize us to access those accounts only as necessary to provide requested workflows.

Your use of third-party services remains subject to their own terms and policies.

8. Acceptable Use

You may not use the Service to:

• infringe intellectual property rights
• upload unlawful, harmful, or deceptive content
• violate platform policies
• interfere with the Service or other users
• abuse rendering, processing, or storage resources
• reverse engineer or benchmark the Service to build a competing product

We may suspend or terminate accounts that violate these rules.

9. Commercial Use

You may use exported outputs for commercial purposes, including client delivery, advertising, social publishing, and monetized channels, provided you have the rights to the source material.

10. Data Deletion and Account Retention

When content is deleted by you or upon account closure, uploaded media, generated outputs, and related project files are removed from the Service within a reasonable period, except where temporary retention is required for backups, security, fraud prevention, or legal compliance.

If an account remains inactive for 24 months, we may delete or anonymize the account and associated personal data in accordance with our Privacy Policy and applicable law.

11. Intellectual Property

The Service, including software, models, workflows, interfaces, branding, and documentation, is owned by onano.app and protected by intellectual property laws.

Except for your User Content, no rights are transferred to you other than the limited right to use the Service.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

We do not guarantee uninterrupted availability, error-free outputs, or that generated results will meet your business goals.

13. Limitation of Liability

To the maximum extent permitted by law, onano.app will not be liable for indirect, incidental, special, consequential, or loss-of-profit damages.

Our total liability for any claim related to the Service will not exceed the amount you paid us in the previous 12 months before the claim arose.

14. Termination

You may stop using the Service at any time.

We may suspend or terminate access if you violate these Terms, fail to pay fees, create legal risk, or misuse the Service.

15. Governing Law

These Terms are governed by the laws of Sweden.

Any dispute arising out of or in connection with these Terms shall be resolved by Swedish courts, with Stockholm District Court as the court of first instance.
